Terms of service
Last updated 4 November 2026
1. The service
- Sunwin One for the number of tablets in your licence, including every feature and all updates while your subscription runs.
- The owner portal and the cloud: syncing between your tablets, daily cloud backups and reports.
- Setup as described in your quote: loading your menu or service list, connecting printers, cash drawer and card reader, and a walk-through for your staff.
- Support by email at support@sunwin.sg. We aim to reply within one business day.
2. Fees and payment
- A one-time setup fee and a monthly subscription fee, as in your quote. Prices are in Singapore dollars; GST is added where it applies.
- The monthly fee is billed in advance for each month. Invoices are due within 14 days.
- We can change the monthly fee with at least 30 days' notice by email. If you don't accept a change, you can cancel before it takes effect.
- Card payments are between you, your customer and Stripe (see section 5). If a Sunwin fee per card payment applies, it is stated in your quote.
3. Term and cancelling
- Your subscription runs month to month with no minimum term.
- You can cancel at any time with 30 days' notice by email. Your subscription ends at the end of that notice; fees already paid for the notice period are not refunded.
- The setup fee covers work already done and is not refundable.
- We can end the subscription with 30 days' notice, or straight away if you seriously breach these terms (for example, illegal use) and don't fix it within 14 days of being told.
4. If a payment is late
We remind you first. If the subscription isn't renewed, the app keeps working until one hour after your closing time on the day it notices, so it never stops during service, and then locks until the subscription is renewed. Locking never deletes your data: renew and everything is there as you left it.
You also pay any reasonable costs we incur in collecting amounts that are overdue, such as debt collection or legal costs.
5. Card and PayNow payments
- Card payments use your own Stripe account. You sign up with Stripe and accept Stripe's terms; card money goes from Stripe to your bank account. Sunwin never holds your money.
- Stripe decides whether to approve your account, which cards it accepts, its fees and when it pays out. Disputes and chargebacks are handled between you and Stripe.
- PayNow payments go straight from your customer's bank to yours. The app shows the QR code but can't see whether money arrived: check your banking app before handing over the order.
6. Your responsibilities
- Provide the tablets, printers and other devices, and an internet connection for syncing and card payments.
- Check your prices, tax settings and receipts are right for your business, and tell us straight away if your GST registration changes.
- Keep staff PINs private, give each person their own login, and switch logins off when staff leave.
- Follow the law in using Sunwin One, including Singapore's PDPA for your customers' and staff's personal data. For example, only send marketing to customers who agreed to it.
- Count your cash and check your daily reports; tell us quickly if something doesn't look right.
7. Your data
- Your business data (sales, menu, customers, staff) belongs to you. We use it only to provide Sunwin One, as our privacy policy describes.
- You can ask for a full export at any time: spreadsheets and a backup file.
- When the subscription ends we keep your cloud data for 60 days, so you can come back or take an export, and then erase it. Copies on your own tablets stay with you.
How we handle personal data is set out in our privacy policy.
8. Availability
Sunwin One is built to keep selling without the internet: orders, receipts, cash and the kitchen display on your Wi-Fi keep working offline, and catch up when the connection returns. We aim to keep the cloud, portal and card payments available at all times, but we can't guarantee they will never be interrupted, for example by planned maintenance (which we try to do outside opening hours), by your internet connection, or by services we rely on such as Stripe.
9. Fair use and suspension
Use Sunwin One only for your own business. Don't copy, resell, take apart or try to get around the licence, interfere with the service or other businesses' data, or use it for anything illegal.
We may suspend access, for example for a tablet or a login, if we reasonably believe it is needed to protect the service, your data or other businesses (such as a lost tablet, a security threat or misuse). Where we can, we tell you first and restore access as soon as the problem is solved.
10. Who owns what
Sunwin owns the Sunwin One software, apps, portal and website. While your subscription runs, you may use them for your business on the number of tablets in your licence. Your data, logo and photos stay yours.
11. What we promise
We provide Sunwin One with reasonable care and skill, and fix faults we are told about within a reasonable time. Apart from what these terms say, and as far as the law allows, we make no other promises about the software, for example that it will be free of errors or interruptions or suit every purpose.
12. Liability
- Sunwin's total liability under this agreement is limited to the subscription fees (the monthly fees, not the setup fee) that you paid us in the 12 months before the event that led to the claim.
- We are not liable for indirect or consequential loss, or for lost profits, revenue, goodwill, or data that could have been recovered from your backups.
- We are not liable for problems caused by your devices, your internet connection, or third-party services such as Stripe, or by events outside our reasonable control such as power or internet outages, failures of our providers, natural disasters, epidemics or government action.
- A claim must be brought within 12 months of the event that led to it.
- Nothing in these terms limits liability that the law does not allow to be limited, such as for death or personal injury caused by negligence, or for fraud.
13. Claims caused by your use
If someone makes a claim against Sunwin because of how you used Sunwin One, for example illegal use, collecting or using personal data without the consent the law requires, prices or tax you charged your customers, or breaking these terms, you will cover Sunwin's reasonable losses and costs from that claim.
14. Changes to these terms
We may update these terms. For changes that affect you, we email the owner at least 30 days before they apply; if you don't accept a change, you can cancel before it does.
15. General
- This agreement (your quote and these terms) is the whole agreement between us about Sunwin One and replaces anything said or written before.
- If a court finds part of these terms invalid, the rest still applies.
- If we don't enforce a right straight away, we can still enforce it later.
- You may not transfer this agreement to someone else without our written consent. We may transfer it to a company that takes over Sunwin One, and we will tell you if we do.
- Notices are sent by email: to the owner's email address on your account, and to us at the support address below.
16. Law
These terms are governed by the laws of Singapore, and the courts of Singapore decide any dispute.
